2. ONLINE SALES
Teddyshirt accepts and completes purchases through teddyshirt.com.
Customers may contact Teddyshirt by email, telephone, WhatsApp or other available communication channels for enquiries and customer support.
A conversation or enquiry through WhatsApp does not by itself constitute a completed purchase.
A purchase is completed through the Teddyshirt website and its checkout process.
3. PRODUCTS AND MADE-TO-ORDER PRODUCTION
Teddyshirt offers clothing and other products that may be produced after an order is placed.
Where a product is marked or described as made-to-order, the product is manufactured according to the product specifications presented to the customer before purchase.
Depending on the product, the relevant specifications may include:
- Product type
- Material
- Size
- Colour
- Design
- Quantity
- Personalisation
- Other characteristics stated on the applicable product page
The customer is purchasing a product to be manufactured and supplied according to the agreed specifications.
The fact that production takes place after the order is placed does not mean that Teddyshirt represents that the finished physical item is already held in stock.
4. THIRD-PARTY MANUFACTURING AND FULFILMENT
Teddyshirt may use independent third-party manufacturers, printers, fulfilment providers and logistics providers to manufacture and deliver products.
Teddyshirt currently uses Gelato as a third-party production and fulfilment provider.
Gelato and its production partners may:
- Manufacture products
- Print designs
- Package products
- Prepare orders
- Dispatch orders
- Provide tracking information
- Arrange delivery
The production facility used for an order may vary depending on the product, destination, production capacity and fulfilment availability.
The use of Gelato or another third-party manufacturer does not make the customer a party to Teddyshirt's separate agreement with that provider.
The customer's purchase relationship remains with Teddyshirt.
Teddyshirt's obligations to the customer are independent of its separate contractual arrangements with manufacturers and fulfilment providers.
5. INDEPENDENT MANUFACTURING ARRANGEMENTS
Teddyshirt may enter into separate manufacturing or fulfilment arrangements with third-party providers to produce products that Teddyshirt has agreed to supply to customers.
Such arrangements are separate from the customer's purchase agreement with Teddyshirt.
The manufacturer's ability or inability to perform its separate agreement does not by itself cancel Teddyshirt's obligations to the customer.
Where Teddyshirt cannot fulfil an accepted order, Teddyshirt will provide the remedy required under the applicable terms and law.
6. PRODUCT INFORMATION
We make reasonable efforts to provide accurate information about products before purchase.
Product information may include:
- Product images
- Product type
- Material
- Dimensions or sizes
- Colours
- Design information
- Personalisation options
- Production information
- Estimated delivery information
Customers should review the product information carefully before placing an order.
Product images may vary slightly from the final physical product because of screen settings, lighting, manufacturing variations or other reasonable differences that do not materially change the product.
7. CUSTOMER-SPECIFIED PRODUCTS AND PERSONALISATION
Where a product allows the customer to provide personalisation or specifications, the customer must provide accurate information.
Personalisation may include:
- Names
- Text
- Photographs
- Artwork
- Logos
- Customer-selected designs
- Other customer-provided content
The customer confirms that they have the necessary rights and permissions to provide content for production.
Teddyshirt may refuse content that we reasonably believe:
- Infringes third-party rights
- Violates applicable law
- Contains unlawful material
- Is abusive, fraudulent or misleading
- Cannot reasonably be produced
8. ORDERING
When a customer submits an order through teddyshirt.com, the customer is requesting the supply of the selected product according to the information displayed during the purchase process.
Before submitting an order, the customer should verify:
- Product
- Quantity
- Size
- Colour
- Personalisation, where applicable
- Delivery address
- Contact information
- Total price
- Delivery charges
Teddyshirt will take reasonable steps to allow customers to identify and correct errors before submitting the order.
9. ACCEPTANCE OF ORDERS
An order is subject to acceptance by Teddyshirt.
Teddyshirt may refuse or cancel an order where reasonably necessary, including where:
- The requested product is unavailable
- There is an obvious pricing error
- There is an obvious product-description error
- A technical error affected the order
- We reasonably suspect fraud or unlawful activity
- We cannot reasonably fulfil the order
- Customer-provided information is materially incomplete or unusable
Where payment has already been taken and Teddyshirt cancels an order, the amount legally due to the customer will be refunded.
10. ORDER CONFIRMATION
After an order is accepted, Teddyshirt will provide an order confirmation using the contact information supplied by the customer.
The order confirmation may include:
- Order number
- Date of order
- Products ordered
- Product specifications
- Quantity
- Price
- Delivery charges
- Taxes or other applicable charges
- Delivery address
- Billing information
- Applicable cancellation and refund information
Customers should retain the order confirmation for their records.
The order confirmation is an important record of the purchase and the agreed order details.
11. CONTRACT AND ORDER RECORD
The contractual purchase relationship is between the customer and Teddyshirt.
The applicable purchase terms consist of the information and terms provided to the customer before and at the time the order is placed, including the applicable product information, price, delivery information, these Terms of Service, and the applicable cancellation and refund terms.
The order confirmation provides a record of the transaction and the specific order placed.
12. 24-HOUR CANCELLATION FACILITY
Teddyshirt provides an additional 24-hour cancellation facility following successful payment.
Where Teddyshirt receives a cancellation request within 24 hours and production has not commenced, Teddyshirt will normally cancel the order and refund the amount paid to the original payment method.
After 24 hours, the order may already have been submitted for production.
Where production has commenced, Teddyshirt may no longer be able to provide a voluntary cancellation or modification.
This additional 24-hour facility does not remove, restrict or reduce any statutory consumer right.
13. STATUTORY CANCELLATION RIGHTS
Where applicable law gives a customer a statutory right to cancel an online purchase, that right applies independently of Teddyshirt's voluntary 24-hour cancellation facility.
For standard goods purchased online, UK distance-selling rules may provide a cancellation period following delivery.
The customer does not generally need to provide a reason where a statutory cancellation right applies.
Certain goods may be exempt from the statutory cancellation right, including goods genuinely made to the customer's specifications or clearly personalised, where the legal requirements for the exemption are satisfied.
The mere fact that a product is manufactured after an order is placed does not automatically remove statutory cancellation rights.
14. PERSONALISED GOODS
Where a product is genuinely personalised or made specifically to the customer's individual specifications, the applicable statutory cancellation exception may apply.
Examples may include products containing:
- Customer-provided photographs
- Customer-specific names
- Customer-specific text
- Customer-specific artwork
- Other genuine individual personalisation
Whether an exception applies depends on the actual product and applicable law.
15. CANCELLATIONS
Customers may submit cancellation requests by:
Email:
teddyshirtsupport@gmail.com
Telephone:
+44 7576 038391
WhatsApp:
+44 7576 038391
Where a statutory cancellation right applies, customers may exercise that right using a clear communication stating the decision to cancel.
16. REFUNDS
Refunds are handled according to the Teddyshirt Return and Refund Policy.
Where a refund is required under applicable law or under these Terms, Teddyshirt will process the applicable refund.
Teddyshirt will not retain money to which the customer is legally or contractually entitled.
17. FAULTY, DAMAGED, INCORRECT OR MISDESCRIBED PRODUCTS
Products supplied by Teddyshirt must comply with applicable legal requirements.
If a product is:
- Faulty
- Damaged
- Incorrect
- Materially different from its description
- Otherwise not in conformity with the contract
the customer should contact Teddyshirt.
Depending on the circumstances and applicable law, the customer may be entitled to:
- Repair
- Replacement
- Price reduction
- Refund
- Rejection of the goods
- Another applicable statutory remedy
Nothing in these Terms removes or restricts a right that cannot legally be removed or restricted.
18. DELIVERY
Delivery options, charges and estimated delivery periods will be displayed during checkout where applicable.
Delivery estimates depend on factors including:
- Product
- Production time
- Production location
- Delivery destination
- Shipping method
- Carrier conditions
Where applicable law imposes a delivery deadline, Teddyshirt will comply with that requirement unless another lawful delivery period has been agreed.
19. DELIVERY ADDRESS
Customers are responsible for supplying an accurate delivery address.
Where an order cannot be delivered because the customer supplied incorrect or incomplete information, Teddyshirt may contact the customer to arrange an appropriate solution.
Additional costs resulting directly from incorrect customer-provided information may be charged only where legally permitted and where properly disclosed.
20. DELIVERY AND RISK
Teddyshirt remains responsible for the goods until responsibility legally passes to the customer under applicable law.
The use of Gelato, another manufacturer, fulfilment provider or delivery carrier does not by itself transfer responsibility to the customer.
21. PRICING
Product prices are displayed on teddyshirt.com.
The total amount payable will be shown before the purchase is completed.
Where applicable, delivery charges, taxes and mandatory charges will be included or clearly disclosed before purchase.
We may correct obvious pricing errors before accepting an order.
22. PAYMENT
Payment must be completed through the payment methods made available during the Teddyshirt checkout process.
The customer confirms that they are authorised to use the payment method used for the order.
Teddyshirt does not intentionally collect complete payment-card information where such information is processed directly by a third-party payment provider.
23. THIRD-PARTY SERVICES
Teddyshirt may use independent providers for:
- E-commerce
- Website hosting
- Payment processing
- Manufacturing
- Printing
- Production
- Fulfilment
- Packaging
- Shipping
- Delivery
- Analytics
- Security
- Customer support
Each provider may have separate terms and privacy policies.
Teddyshirt remains responsible to the customer for its own contractual obligations.
24. INTELLECTUAL PROPERTY
Unless otherwise stated, Teddyshirt owns or has permission to use the intellectual property displayed on teddyshirt.com.
This may include:
- Teddyshirt branding
- Product designs
- Logos
- Text
- Graphics
- Photographs
- Website content
Unauthorised copying, reproduction, distribution or commercial exploitation is prohibited.
25. CUSTOMER CONTENT AND THIRD-PARTY RIGHTS
A customer who submits content for production represents that they have the necessary rights and permissions to use that content.
Customers must not submit material that infringes:
- Copyright
- Trademarks
- Privacy rights
- Personality rights
- Other third-party rights
Teddyshirt may reject content where reasonably necessary.
26. PRIVACY
Personal information is handled according to the Teddyshirt Privacy Policy.
Where necessary to process and fulfil an order, relevant information may be provided to:
- Payment providers
- Manufacturers
- Gelato
- Production partners
- Fulfilment providers
- Shipping providers
Such information is used for the purposes described in the Privacy Policy and applicable law.
27. WEBSITE USE
Customers must not:
- Attempt unauthorised access to the website
- Interfere with website operation
- Introduce malware
- Bypass security controls
- Use the website for fraud
- Use the website for unlawful activity
- Cause unreasonable disruption
28. COMPLAINTS
Customers should contact Teddyshirt first where they have a complaint.
We will make reasonable efforts to investigate and resolve legitimate complaints.
29. CHANGES TO THESE TERMS
We may update these Terms when reasonably necessary.
The terms applicable to an order will generally be those provided to the customer before or at the time the contract is entered into.
Changes made later will not retrospectively remove rights already granted to the customer under applicable law.
30. LIMITATION OF LIABILITY
Nothing in these Terms excludes or restricts liability that cannot legally be excluded or restricted.
Nothing in these Terms removes or restricts statutory consumer rights.
31. EVENTS OUTSIDE REASONABLE CONTROL
Teddyshirt is not responsible for delay caused by circumstances genuinely outside its reasonable control, to the extent permitted by applicable law.
Examples may include:
- Severe weather
- Major transport disruption
- Manufacturing disruption
- Strikes
- Technical failures
- Government restrictions
- Natural events
Nothing in this clause removes mandatory consumer rights.
32. GOVERNING LAW AND CONSUMER RIGHTS
These Terms are intended to operate consistently with applicable law and mandatory consumer-protection requirements.
Nothing in these Terms prevents a consumer from relying on mandatory legal protections applicable to their purchase.
